1. GENERAL TERMS
1.1 The BONUS MILES Program (hereinafter the "Program" or "BONUS MILES") of shipping company HELLENIC SEAWAYS MARITIME S.A., based in Piraeus, 6, Astingos Street, Karaiskaki Square (hereinafter "HSW"), is a program rewarding regular customers sailing with HSW vessels performing internal ferry services (hereinafter the "Vessels"). These passengers are given a bonus to collect nautical miles travelled, as calculated by the ministry of Mercantile Marine and other competent public authorities and published on the HSW website www.hsw.gr (hereinafter the "Miles"), and their corresponding fares, by exchanging them with a "Bonus Ticket") and additional services offered by the program. "Freight"/Fare means the total sales value of each passenger transfer ticket or vehicle transport receipt, issued for the performance of a ferry trip (including taxes, fees and other legal costs).
1.2 These Terms and Conditions govern the relations between HSW and passengers participating in the program (hereinafter the "Members"), as well as the process to participate, collect and redeem miles. HSW reserves the right to modify these Terms, at its sole discretion. In this case HSW will inform Members of any change by republishing them in any future version of the present, as well as on its website www.hsw.gr.
1.3 As part of the Program, HSW notifies to passengers tables with data (vessel itineraries, fares, ticket categories, Miles, promotions) and the conditions for obtaining Miles and fares and redeeming those with Bonus Tickets and other services offered. These data will be determined solely by HSW, which reserves the right to change them at any time. In this case, an immediate notification of these changes to passengers follows via HSW website www.hsw.gr.
1.4 The Program does not apply where prohibited or restricted by law.
1.5 A breach of the Terms by Members may result in cancellation of all Miles of a Member, of all offers, even the membership itself.
2. ΒONUS MILES: PARTICIPATION
2.1 A right to participate in this Program have all adult passengers of HSW. All forms of legal entities, as well as individual businesses are excluded. For members with minor children, the latter have a right to participate in the Program too, if requested by the parent / custodian - Member, under the conditions specified herein.
2.2 Participation in the program is strictly personal and may not be transferred or assigned by the Member to any third party.
2.3 To participate in the Program, Members must register by completing a registration form they can find the person in the relevant document or HSW website www.hsw.gr.
2.4 Registration by Application Form: The participation form is available from the whole sales network of HSW (headquarters of HSW, collaborating tourist offices, agencies, port offices, HSW ticket offices and Vessels). The prospective member is required to complete the requested information in its entirety and sign the application form, and subsequently send the application to the address: HELLENIC SEAWAYS S.A., 6, Astingos Street, Karaiskaki Square, Piraeus, 185 31, stating "for the Bonus Miles Program". Applications not fully completed and / or signed will not be accepted.
2.5 Online Registration: Registration can also be performed online through the website www.hsw.gr. Applicants are required to complete all the requested data of on-line application, which is automatically recorded in the electronic system of HSW. Then, HSW will send this completed application in paper to the person concerned for his / her signature and return to the address stated in clause 2.4.
2.6 By completing and signing the application as per above, the applicant agrees to abide by the Terms and Conditions of the Program, as defined by HSW.
2.7 ΗSW, immediately after receipt and acceptance of any properly completed and signed by hand application (under conditions provided in 2.4 and 2.5), will send to the member a plastic-magnetic HELLENIC SEAWAYS LOYALTY CLUB card (the "Card"). With the acquisition of this Card, Members obtain the full benefits of participation in the Program. For minor children as provided in 2.1, a separate card will be issued for each child ("Junior Card").
2.8 Members have the capability, upon submission to the HSW offices of the application form, as provided in clause 2.4, or the automatic registration of the on-line application, as provided in clause 2.5, and until the receipt of the Card, to collect Miles and their corresponding fares, if they keep and submit to the Customer Service Department of HSW, at the address stated in clause 2.4 above, individual tickets of themselves or their minor children coming from trips made in the meantime by the card holders themselves and / or their minor children. In this case, and if the Member had transported in this same journey his/her own vehicle, too, he/she must keep and submit to the Customer Service Department of HSW the corresponding transport receipt of the accompanying vehicle as well. For the collection and recording of these data, the procedures of Article 4 hereof are to apply.
2.9 Each Member may maintain only one Membership account in the Program (the "Account"), which cannot be transferred or assigned to third parties. For Members with minor children separate accounts will be kept for each minor child ("Child Account"). If there are two or more Accounts / Child Accounts, extra accounts will be canceled and the oldest account will be maintained. Miles and corresponding Fares possibly present in the Accounts to be canceled, will be transferred into the Account which will be maintained. Exceptionally, in case of theft or loss, the old account will be canceled and a new one shall be kept.
2.10 HSW reserves the right to cancel participation of any Member in the Program, in any case of breach of the Terms & Conditions. Any request to redeem Miles or corresponding Fares made before or after the cancellation of participation will be judged by HSW as appropriate.
2.11 If a member wishes to terminate his/her participation in the Program, he/she should contact the Customer Service Department of HSW, at the address stated in clause 2.4 (tel: +30 210 4199100, MON-FRI 8:30 to 16:30)
3. TIERS - CARDS
3.1 The Program consists of two participation tiers: simple and golden, identified by Mileage onboard. Depending on the participation tier, the Program provides a different card: the HELLENIC SEAWAYS LOYALTY CLUB (simple tier) and HELLENIC SEAWAYS LOYALTY CLUB GOLD (golden tier).
- HELLENIC SEAWAYS LOYALTY CLUB Card: This tier includes Members who have accumulated 1,000 miles from their trips to various destinations with the Vessels. By completing this threshold, the Member enjoys the privileges of clause 5.1 of the present.
- HELLENIC SEAWAYS LOYALTY CLUB Golden Card: This tier includes Members who have accumulated 3,000 miles from their trips to various destinations with the Vessels. By completing this threshold, Members enjoy, apart from the privileges of the simple tier, the following privileges:
- Class upgrade, from Economic to Distinguished B (Business) or from Distinguished B (Business) to Distinguished A (V.I.P.) in the high speed vessels of HSW (subject to availability).
- Class upgrade, from Economic to Distinguished B (Business) or from Distinguished B (Business) to Distinguished A Lounge (V.I.P.) in the conventional-type Vessels of HSW (subject to availability).
3.2 Each Card or Junior Card is strictly personal, non-transferable and non-assignable and states the full name of the beneficiary-Member or the beneficiary-minor; its number (customer code) is unique for each Member or beneficiary-minor and is evidence of participation in the Program. Cards and Junior Cards always remain the property of HSW, which has the right to withdraw or revoke them or replace them with a card of the same tier. Cards and Junior Cards are not credit cards and cannot be used as valid identification documents during check-in.
3.3 HSW may alter at any time without notice the conditions for obtaining any Card or Junior Card and privileges enjoyed by Members or the beneficiary minors at every level.
3.4 In the event of theft, damage, destruction or loss of the Card or the Junior Card, the Member shall declare in writing to the Customer Service Department of HSW at the address stated in clause 2.4. This card will be replaced with a New Card or a New Junior Card that will be sent to the Member. In case of theft or loss the New Card or New Junior Card will have another number (customer code) and the number of the previous one will be cancelled for safety reasons. In case of partial or total destruction of the Card or the Junior Card, the Member may ask to keep the old number to the new card which will replace it. In this case the old Card or Junior Card should be returned to HSW.
4. MILES / FARES: COLLECTION - REDEMPTION
4.1 Miles for each trip made by the Member himself/herself and the corresponding Fare indicated on the relevant transfer ticket will be entered each time in the Member's Account. The above procedure will be carried out during the Member's check-in on board. To this end, the Member shall, at ticket issuance, display the Card to the body issuing the ticket (HSW ticket office or cooperating tourist office or agency) so that the Card number be entered on the ticket; the Member must confirm that the body issuing the ticket has made this entry.
4.2 In addition, if the Member transports a privately-owned vehicle, the corresponding Fare indicated on the relevant transport receipt of the accompanying vehicle will be registered in the Account; this receipt is required to indicate the vehicle’s registration number. This registration will be carried out during the Member's check-in on board, as referred to in clause 4.1 above. This procedure does not apply to unescorted vehicles, goods, small packets or vehicles on consignment.
4.3 Benefits of Miles’ and corresponding Fare collection are also provided to minor children of Members, as follows: in the Child Account are recorded both Miles of each trip made by the child himself/herself, either escorted by a parent/custodian-Member or by a third party, and the corresponding Fare indicated on the relevant transfer ticket, which should necessarily have been issued in the name of travelling child. The registration will be carried out during the child’s check-in on board. To this end, the Member or the child escort shall, in issuing the relevant transfer ticket for the child, display the Junior Card to the body issuing the ticket (HSW ticket office or cooperating tourist office or agency) so that the Junior Card number be entered on the ticket; the Member / escort of the child must confirm that the body issuing the ticket has made this entry.
4.4 Upon completion of the 1,000 Miles of the simple tier, HSW will credit the Account with 10% of the total Fare of individual tickets and transport receipts for Member’s accompanied vehicle(s), corresponding to Mileage, and the Member will be entitled to exchange the amount to be credited or part thereof, at will, with a Bonus Ticket of an equal value to perform a journey by any Vessel in any route line of his/her choice.
4.5 In addition, on completion of the 1,000 Miles threshold of the simple tier by each minor child of a Member, HSW will credit the Child Account with 10% of the total ticket Fares corresponding to the Mileage of this child. In this case, only the parent / custodian of the child will be entitled to exchange the amount to be credited or part thereof, at will, with a Bonus Ticket of an equal value, on behalf of the minor child, to perform a journey by any Vessel in any route line of his/her choice. This option shall be exercised by any parent / custodian of the minor child until the end of the amount credited each time.
4.6 The process to credit 10% of the Fares indicated in the clauses 4.4 and 4.5 above, will be conducted by HSW on the very next day of the completion of the minimum Miles threshold. Upon completion of this process, corresponding Miles and Fares will be automatically deducted from the Member's Account or Child Account, as appropriate. Each individual ticket or vehicle transport receipt will be credited only once.
4.7 Miles and corresponding Fares collected will appear in the Member's Account or Child Account, as appropriate, within forty-eight (48) hours after the execution of the trip. Each Member may be informed of the Miles and corresponding Fares he/she has collected either himself/herself or on behalf of his/her minor child through the HSW website www.hsw.gr or through the Customer Service Department of HSW (tel: +30 210 4199100, MON-FRI 8:30 to 16:30).
4.8 The difference in the value of an individual ticket of a Member or his/her minor child due to class upgrade in any Vessel will be registered in the Member's Account or Child Account, respectively, at the Accounting Office of the Vessel at the time the upgrade process is performed. These amounts will be equally counted in any Account or Child Account during the process to credit 10% of the Fares provided in the clauses 4.6 and 4.7 above.
4.9 Members shall keep ticket stubs and vehicle transport receipts or any other evidence or document related to the process of Miles and corresponding Fares collection until these Miles and corresponding Fares appear on the Member's Account or Child Account, where appropriate.
4.10 In case of failure to register Miles or their corresponding Fares, the Member shall declare and send to the Customer Service Department of HSW at the address referred to in the clause 2.4 (tel: +30 210 4199100, MON-FRI 08:30-16:30), any evidence he/she has kept to record missing data.
4.11 Appeals relating to registrations in the Member's Account or Child Account, where appropriate, should be reported to HSW as referred to in the clause 4.10 above, within six (6) months from the date of travel, otherwise it will be deemed that they have been accepted by the Member, on behalf of himself/herself or his/her minor child, as appropriate.
4.12 Miles are only recorded in the Account of the Member or of his/her minor child who has travelled them. Members may not transfer Miles in any way or assign them to any third party, nor can they combine them with Miles of their minor children or other Members so as to be jointly entitled to any offer.
4.13 In case of cancellation of the Program as provided in the Terms, all Miles collected are automatically cancelled and are no longer interchangeable with offers.
4.14 Miles travelled with Bonus Tickets and their corresponding Fares are exempted from the procedures described in the clauses 4.1 to 4.13 above.
5. BONUS TICKET
5.1 Miles and their corresponding Fares are only exchanged with Bonus Tickets, have no commercial value and cannot in any case be exchanged for cash. Any disposal (sale, exchange, etc.) of Miles or offers is automatically considered null and void and results to the termination of the Member's participation in the Program.
5.2 Provision of Bonus Tickets is subject to availability of seats onboard. HSW may limit or exclude the availability of exchangeable seats for any Vessel itinerary and / or by period and / or by destination. The general availability of seats does not necessarily entail the possibility to supply Bonus Tickets under the Program.
5.3 Members may transfer the right to issue tickets to relatives or any third person they shall indicate in writing to the Customer Service Department of HSW at the address referred to in clause 2.4 (tel: +30 210 4199100, MON-FRI 08:30-16:30).
5.4 All Bonus Tickets will be issued for confirmed seats.
5.5 Bonus Tickets will not be issued as "open", i.e. with an open date of departure and / or return.
5.6 Reservation and issuance of Bonus Tickets must be made at least three (3) days before the date of travel, subject to availability of seats.
5.7 Receipt of Bonus Tickets by Members will be conducted at the HSW Headquarters, referred to in clause 1.1 of this, or at any cooperating travel agent or agency, with the demonstration of the Card and the Member’s Identity Card; an acknowledgment will be signed each time.
5.8 If, after the issuance of a Bonus Ticket and before the date of the respective travel, the Member indicates that he/she does not wish to travel with his/her Bonus Ticket, he/she is entitled to ask its substitution by another ticket of a specific date and a specific destination, which should be issued by the ticket office of HSW or travel agent or the agency that has issued the Bonus Ticket.
5.9 If, after the issuance of a Bonus Ticket, the Member does not appear to perform the journey with this, the Bonus Ticket will be cancelled pursuant to the respective applicable ticket terms listed on its rear.
5.10 Bonus Tickets cannot be issued for the following periods (Black-out periods): from 01.01 until 08.01 of each year, on Green Monday of each year, on the Holy Week of Orthodox Easter and on Easter Monday of each year, on May 1st of each year, on Holy Spirit day and its immediately preceding weekend (Friday-Saturday-Sunday) of each year, from 12.08 until 18.08 of each year, from 25.10 until 28.10 of each year, and from 23.12 until 31.12 of each year. This restriction does not apply to the Saronic Gulf lines.
5.11 In the event of theft or loss of a Bonus Ticket, the Member shall declare in writing to the Customer Service Department of HSW at the address stated in clause 2.4. Bonus Tickets lost or stolen shall not be reissued by HSW.
5.12 The transportation of passengers on Vessels is governed by the applicable legislation on maritime cabotage.
6. OTHER TERMS
6.1 HSW may at its sole discretion cancel the Program at any time, upon prior written notice of one (1) month to Members.
6.2 In the event of bankruptcy, acquisition, merger, dissolution in any way of HSW, the Program is automatically canceled and Accounts and all collected Mileage and Fares of Members or their minor children-Junior Card holders are simultaneously cancelled. Therefore, HSW will no longer have any obligation towards the Members, nor the Members shall be entitled to raise any claim against HSW.
6.3 The liability of HSW against Members or their minor children-Junior Card holders resulting from the Program and its operation is limited. HSW does not bear any liability-even for slight negligence-for any initial or supervening loss related to or arising from the use and implementation of the Program during its term and / or after the termination thereof. In any event, any liability of HSW, contractual or non-contractual or otherwise, to compensate Members or their minor children-Junior Card holders for damage, loss or expense that might arise from any act or omission on the operation of the Program will be limited only to re-credit the Member's Account or Child Account, if appropriate, with Miles and Fares corresponding to the offer under examination, provided that the Program will be in effect at this time. HSW is not responsible for losses, delays, consequential or indirect damages.
6.4 Members ought to inform in writing HSW on any change of their personal data (name, surname, address, etc.).
6.5 HSW is not responsible for any injury or damage to Members or third parties as a result of false or inaccurate declarations of personal data of Members or non-written disclosure to HSW of any change of their personal data.
6.6 HSW bears no responsibility for any errors, omissions or changes to the text and content of the Terms when printing the document in question or other related forms of the Program, or its display on the website www.hsw.gr, or from acts or omissions of third parties - none of its servants, who may have any connection with the Program.
6.7 The terms and conditions of the Program and consequent legal relationship between HSW and Members is governed by Greek law. Courts with jurisdiction to resolve any disputes arising from participation in the Program and its application are specified to be the Courts of Piraeus.
7. PROTECTION OF PERSONAL DATA (Law 2472/1997)
7.1 HSW states that personal data of passengers and their children gathered for the purposes of the Program will be kept on file and processed by HSW for the purposes of the Program or for statistical and economic purposes or for operational and IT service.
7.2 By completing and signing the written application form to enrol in the Program or by completing and sending the online application form according to the process of the clause 2.5 hereof, passengers are deemed to automatically provide HSW their consent under the provisions of Law 2472/97 for the use and processing of personal data of themselves or their children, for the above purposes.
7.3 Members have the right to access their personal data and update or even object to any further processing of their data under the provisions of Law 2472/97, as applicable.
